Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of REPhotoFlow (the "Service"), operated by Luminous Productions ("Luminous Productions," "we," "us," or "our"). By booking a shoot, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

REPhotoFlow is a real estate photography booking and media management platform. The Service includes:

• Scheduling and booking of real estate photography, videography, and related on-site services
• Delivery of photos, video, floor plans, and other media to clients and their agents
• AI-assisted editing features such as virtual staging, sky replacement, and object removal
• Floor plan generation and scanning integrations
• A prepaid credit system for certain premium or add-on features
• Payment processing for bookings, deposits, and add-on purchases
• Tools for photographers and contractors to manage assignments and payouts

REPhotoFlow is currently operated by Luminous Productions for its own real estate photography business. We may in the future offer REPhotoFlow as a platform to other photography studios; if so, additional or updated terms may apply to that use case.

3. Account Registration

To use certain features, you must register for an account or complete a guest booking. You agree to:

• Provide accurate, current, and complete information (including contact and property details)
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

Guest bookings made without a full account are still subject to these Terms.

4. Booking & Scheduling

• Bookings are confirmed once submitted through the booking flow and, where applicable, payment or a deposit is received.
• You are responsible for providing accurate property access information, contact details, and any special instructions needed for the shoot to proceed on schedule.
• Rush delivery, weekend/after-hours service, and travel outside our standard service area may incur additional fees, which are disclosed before you confirm your booking.
• We reserve the right to reschedule a shoot due to weather, safety concerns, photographer availability, or circumstances beyond our control. We will make reasonable efforts to notify you promptly and offer the next available time.
• Someone with lawful authority over the property (owner, listing agent, or authorized representative) must be able to grant access for the shoot; you represent that you have this authority when you book.

5. Payment Terms

Payments are processed securely through Stripe and/or Square. Depending on the service and package selected, one of the following payment models applies and will be shown to you at booking:

• Full payment at booking — the full order total is charged when you confirm your booking.
• Deposit — a partial deposit is charged at booking, with the remaining balance due before or at delivery.
• Pay-to-download — the shoot is scheduled without upfront payment, and payment is required before final, high-resolution media is released for download.

Credits purchased through our credit system are used to unlock premium add-ons (such as AI editing or additional deliverables) and are non-transferable between accounts. Credits do not expire unless stated otherwise at the time of purchase, and are non-refundable except as required by law or as described in our cancellation policy below.

You authorize us (and our payment processors) to charge your payment method for all fees you incur, including any applicable travel surcharges, rush fees, or weekend fees disclosed at booking.

6. Cancellation & Refund Policy

• You may cancel or reschedule a booking free of charge if you notify us at least 16 hours before the scheduled shoot time.
• Cancellations made after that window are not charged a cancellation fee. However, no-shows or properties that are inaccessible at the scheduled shoot time are subject to the applicable travel fee plus a $25 trip charge.
• Deposits are generally non-refundable once the photographer has been dispatched or the shoot has occurred, except where we are unable to deliver usable media due to an error on our part.
• Refund requests should be submitted within 7 days of the shoot or delivery date and will be reviewed on a case-by-case basis.
• We stand behind our work — see our satisfaction guarantee referenced in the booking flow. If delivered media does not meet reasonable quality standards, contact us and we will re-shoot, re-edit, or issue a partial/full refund at our discretion.

7. Media Ownership & Licensing

• Upon full payment for a shoot, the client (typically the listing agent, broker, or property owner who booked the shoot) receives a license to use the delivered media for marketing and sale of the specific property photographed — including MLS listings, print materials, social media, and branded or unbranded use as applicable to the package purchased.
• Luminous Productions and its photographers retain copyright ownership of all photographs, video, floor plans, and other media created under this Service, except where a separate written agreement transfers ownership.
• The license granted to clients does not permit resale of the raw media itself, use for properties other than the one photographed, or use beyond the marketing/sale period of that listing unless otherwise agreed in writing.
• MLS-branded deliverables (e.g., with brokerage watermarks or MLS-required disclosures) and unbranded deliverables may be subject to different usage terms disclosed at the time of delivery.
• We may use delivered media in our own portfolio, marketing, and website unless you notify us in writing that you opt out of such use.

8. AI-Assisted Editing

Certain features (virtual staging, sky replacement, object removal, and similar AI-assisted edits) use third-party AI services to modify photos. You are responsible for ensuring any AI-edited media you use in a listing complies with applicable MLS rules, fair housing laws, and truth-in-advertising requirements (for example, disclosing virtually staged images where required). We do not guarantee that AI-generated edits will be free of visual artifacts, and we make commercially reasonable efforts to review output quality before delivery.

9. Photographer & Contractor Terms

Photographers, videographers, and editors who perform services through the platform do so as independent contractors of Luminous Productions unless otherwise agreed in writing. Contractors agree to:

• Complete assigned shoots professionally, on time, and in accordance with our shot lists and quality standards
• Upload media promptly through the platform for editing and delivery
• Comply with property access rules, safety practices, and client instructions
• Accept payout terms as configured in their photographer profile, processed on our standard payout schedule

Payouts to photographers are subject to the payout terms and schedule presented in the photographer dashboard and may be adjusted for corrections, chargebacks, or quality issues.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to misrepresent a property's condition
• Upload or request delivery of content that infringes on another party's intellectual property or privacy rights
• Provide false property access authorization
• Attempt to gain unauthorized access to the Service, other users' accounts, or delivered media
• Interfere with or disrupt the Service, including booking, payment, or delivery systems
• Violate any applicable federal, state, or local laws, including fair housing laws

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SERVICE, INCLUDING SCHEDULING, PAYMENT PROCESSING, OR THIRD-PARTY INTEGRATIONS (SUCH AS CALENDAR, STORAGE, OR AI EDITING PROVIDERS).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMINOUS PRODUCTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST BUSINESS OPPORTUNITIES, DELAYED LISTINGS, OR MISSED SALES DEADLINES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold Luminous Productions harmless from any claims, damages, or expenses arising from your use of the Service, content you provide, your violation of these Terms, or your failure to secure proper authorization for property access or media use.

14. Dispute Resolution

If a dispute arises, please contact us first at joe@luminouspro.com so we can attempt to resolve it directly. If a dispute cannot be resolved informally within thirty (30) days, both parties agree that it will be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court. Any arbitration will be administered under the rules of a mutually agreed arbitration provider and held in Hunt County, Texas. You and Luminous Productions each waive the right to a jury trial and to participate in a class action.

15. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Termination does not affect obligations for bookings already completed, fees already owed, or media licensing rights already granted.

16. Changes to Terms

We may modify these Terms from time to time. Material changes will be reflected by an updated "Last updated" date on this page. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
